实施扣押前应当报经公安机关负责人批准；因情况紧急或者物品价值不大，当场实施扣押的，人民警察应当及时向其所属公安机关负责人报告，并补办批准手续。公安机关负责人认为不应当扣押的，应当立即解除。当场实施扣押的，应当全程同步录音录像。
对情节复杂或者重大违法行为给予治安管理处罚，公安机关负责人应当集体讨论决定。
